This document serves as the Terms of Service for all services ("the services") operated by FloatingMilkshake ("I", "me", "my"). Last updated on 2023-04-21 (history is public, see here!). You can reach out with any questions or concerns at me [at] floatingmilkshake [dot] com.

By using any services operated by FloatingMilkshake, you agree to the following Terms of Service ("terms"). If you do not agree to these Terms of Service, you may not use any services operated by FloatingMilkshake.

By using any services operated by FloatingMilkshake, you agree to the Privacy Policy which can be found here.

By using this website, you agree to the usage of cookies. Cookies are currently only used by Cloudflare to prevent threats against web services operated by me. Cloudflare may store cookies on your device to identify you as a legitimate user of the services. If you do not agree with this, you may disable cookies for web services operated by me in your browser's settings.

You are at least of the age required to use the platforms on which the services are provided; for example, to use MechanicalMilkshake, you must be 13 years of age as per Discord's Terms of Service.

You will not use the services for illegal purposes, nor will you use the services to harass, threaten, harm, or otherwise cause distress to any other user.

You will not attempt to disrupt the services for other users.

You will not use the services to distribute malware, viruses, or other malicious content, or content that is illegal or otherwise prohibited by the Terms of Service of any third-party services used by the services. Additionally, you will not use the services to distribute content that violates the intellectual property rights of me nor any third party.

You agree to the Terms of Service of any third-party services that you use in conjunction with the services. As of the last time this document was updated, this only consists of Discord, whose Terms of Service can be found here. You also agree to the Privacy Policy or other relevant policy of any third-party services or platforms used by the services. As of the last time this document was updated, these are:

The services are provided "as is" and without warranty of any kind. The services may be subject to outages, bugs, or other issues. I am not responsible for any damages caused by the services, including but not limited to loss of data or loss of access to the services. Similarly, the services may change at any time without notice to you. I am not responsible for any damages caused by changes to the services. Your right to use the services may also be revoked at any time for any reason, including but not limited to violation of these Terms of Service, without notice to you.

I reserve the right to modify these Terms of Service at any time. If I do so, I will update the "Last updated" date at the top of this document. If you continue to use the services after the terms are updated, you agree to the updated terms. If you do not agree to the updated Terms of Service, you may not use the services. Any failure to enforce these Terms of Service does not constitute a waiver of these terms.
